In Michigan, does a Non-Cust parent have the right to know if the bipolar PhysCus parent is taking their meds?
Legally in Michigan - I'm wondering if a non-custodial parent with a joint legal custody arrangement has the right to know whether the custodial parent (physical custody) (who was diagnosed as bipolar) actually takes their medication. The whirlwind is causing issues with the kids (one also bipolar). The custodial parent, of course says its not the others "business." Has anyone dealt with this topic? Thanks for whatever info you can give me
I would say that it would require a court order. Based on state and federal law medical records are private. Supprisingly, your child's medical records for mental health issues may also be private.
Keep in mind too that the best medical record you could get your hands on would only show if the prescription was filled or not. Unless the custodial parent is subjected to a drug test of some kind, it would be hard to determine if they are actually taking them or not.
If this is a concern, I would contact friend of the court for advice. They may direct you to find an attorney that can proceed with legal action or let you know that it isn't something worth persuing because it won't happen.
